Moderasi Beragama dalam Bingkai Hukum Islam: Rekonstruksi Prinsip Keadilan dan Kemaslahatan Sosial

Religious moderation has emerged as a strategic discourse in responding to the growing complexity of socio-religious life in contemporary Muslim societies. Within the framework of Islamic law, moderation should not merely be understood as a normative middle position, but rather as an ethical-juridical principle oriented toward justice and social welfare. This article aims to reconstruct the concept of religious moderation within Islamic legal thought by positioning justice (al-‘adl) and public interest (al-maṣlaḥah) as its foundational principles. This study employs a qualitative approach through library research, analyzing primary and secondary sources including the Qur’an, Hadith, classical and contemporary works of uṣūl al-fiqh, as well as relevant literature on religious moderation. The findings indicate that religious moderation in Islamic law is deeply rooted in the framework of maqāṣid al-sharī‘ah, which necessitates a balance between textual fidelity and contextual consideration, as well as between legal certainty and substantive justice. This reconstruction affirms that a moderate Islamic legal approach is not permissive, but adaptive and responsive to social realities in order to achieve sustainable social welfare.
